If the prohibited labor requirements in public works contracts identified under Ohio R.C. Chapter 4116, or substantially equivalent state provisions, are found to be lawful by a court of competent jurisdiction, Sections 127.02 and 127.03 shall not apply to any public improvement project which includes state funds appropriate for the purposes of that public improvement.
