The owner, operator or manager of any structure or premises cited by the Building Inspector under this chapter shall have the right to appeal from any order of, or written notice issued by, the Building Inspector within 14 days from the date of legal service of such notice. Such an appeal shall be taken to the Board of Zoning Appeals, which shall hold and conduct a hearing on the citation and appeal therefrom. The Board shall give notice of the time and place of such hearing to the Building Inspector, the Director of Public Safety, the owner, operator and manager of the structure or premises which are the subject of the citation and, if neither the owner, operator nor manager is in possession, also to the occupant of the structure or premises, and to such other interested parties as the Board shall determine. Notice of such hearing shall be served in the manner provided in Section 1332.03. The Board, upon hearing all the facts and evidence, shall issue its order, including its determination whether a violation exists, and if it does, the action to be taken by the appropriate party to abate such violation. The decision and order of the Board shall not be effective unless confirmed by a resolution of Council.
