The use and/or rental of municipal facilities shall be subject to the following terms and conditions:
(a) Damage Deposit. In addition to any fee, cost or expense to be charged for the use of a municipal facility, a damage deposit, in an amount that has been determined by Council upon the recommendation of the Recreation Director, must accompany all applications. Such deposits shall be applied by the City to pay the costs of repairing or replacing any damage to or destruction of the premises or any personal property therein occurring and the balance of such deposit shall thereupon be returned to the applicant. However, where the Service Director determines that an excessive clean-up of facilities is required, as a result of an engagement, a sum shall be charged against such deposit to cover the cost of such clean-up. The applicant shall be liable for any and all expense and/or damage, even where the clean-up and damage expense exceed the damage deposit. The damage deposit provided for herein may be waived by the Recreation Director.
(b) Payment. The applicable charge for the use and rental shall be paid in advance. No engagement shall be secured until payment is received. For multiple engagement bookings, all bookings to be included in the application shall be paid in advance unless waived by the Director of Recreation.. No application shall be considered processed or finalized until payment is received. The Recreation Director is also authorized to waive fees as described in this chapter. All applications are considered "first come, first served." Payment and application procedures shall be completed at least two weeks before the scheduled engagement. Consideration in special cases on emergency basis will be considered by the Recreation Director.
(c) Cancellation and Refunds. In the event an engagement is cancelled, the damage deposit shall be refunded; and further, rental payments shall be refunded in accordance with a schedule that shall be established by Council upon the recommendation of the Recreation Director.
