901.02 APPLICATION; INSURANCE; TRAFFIC CONTROL.
   (a)   Each permit for making an opening or excavation or for work as described in Section 901.01 shall be issued by the Director of Public Service only after a finding by him that such opening, excavation or work will not be detrimental to the public interest. Application for such permit shall be made on a fort. approved by the Director giving the exact location of the proposed opening, excavation or work, the area and depth to be excavated, the time required for the work and such other facts as may be required.
   (b)   In addition, no permit shall be issued until the applicant has furnished evidence of liability insurance for bodily injury in the minimum amount of one hundred thousand dollars ($100,000) per person, three hundred thousand dollars ($300,000) per occurrence and for property damage in the minimum amount of one hundred thousand dollars ($100,000), or a combined single limit of liability in the amount of three hundred thousand dollars ($300,000). Evidence of the aforesaid insurance shall be in the form of a certificate of insurance which shall certify the following:
      (1)   The insurance coverage is written on a comprehensive general contract with evidence of motor vehicle liability insurance in the above limits;
      (2)   Products and completed operations is in force;
      (3)   Any “XCU”exclusions are deleted;
      (4)   The City of Willowick is added as an additional insured;
      (5)   The City of Willowick is provided thirty days advance notice of cancellation, termination or partial change in coverage or limits of liability.
   (c)   The aforesaid insurance shall safeguard the City from any liability for injuries or damages which may occur from such opening, excavation or work. Notwithstanding any of the above provisions, no private or public utilities shall be required to furnish a public liability insurance policy, provided that in lieu thereof such utility agrees in writing to indemnify and save harmless the City from any and all damage and injury occasioned by or arising out of any work which it performs in the streets of the City.    (d)   An applicant for a permit for any construction done within a public right-of-way shall file Maintenance of Traffic Plans, in accordance with the Ohio Manual of Uniform Traffic Control Devices, with the Director of Public Service, unless said construction shall exceed a period of one day, in which case the Maintenance of Traffic Plans shall be filed with and approved by the City Engineer.
