Every person, whether acting as an individual owner, employee of the owner, operator or employee of the operator, or whether acting as a mere agent or independent contractor for the owner, employee or operator, or acting as a participant or worker, in any way directly or indirectly who operates a hot tub establishment or any of the services defined in this chapter without first obtaining a license and paying a fee to do so from the City or whoever violates any provision of this chapter shall be guilty of a first degree misdemeanor and shall be fined not more than one thousand dollars ($1,000) or imprisoned for not more than six months, or both. Each day that a violation exists shall be considered a separate offense.
