763.12 LICENSE EXPIRATION, SUSPENSION OR REVOCATION.
   (a)   Any license issued pursuant to the provisions of this chapter shall expire upon any of the following conditions:
      (1)   Discontinuance of the business of the licensee;
      (2)   The removal of a permitted mechanical amusement device from the business premises which is not replaced within thirty days by another mechanical amusement device shall cause the expiration of the permit for such mechanical amusement device;
      (3)   Transfer or sale of the business to another individual, partnership, corporation or other entity.
   (b)   All licenses issued pursuant to the provisions of this chapter are subject to suspension or revocation by the Safety Director upon any of the following conditions
      (1)   Willful misrepresentation by the licensee or his agent in applying for the license.
      (2)   Conviction of the licensee for any felony or misdemeanor involving force, violence, disorderly conduct, moral turpitude, gambling or involving any violation of this chapter or other provisions of the Codified Ordinances of Willowick or the laws of the State of Ohio pertaining to business operation.
      (3)   The existence of nuisance to customers, other businesses or the public arising out of the operation of the amusement devices on the licensees' premises. The definition of “nuisance” for the purposes of this subsection includes the violation of any provision of the Codified Ordinances of Willowick or the Ohio Revised Code pertaining to force, violence, disorderly conduct, moral turpitude or gambling.
      (4)   Failure to comply with the provisions of Chapter 191 of the Codified Ordinances of Willowick, or any section or provision thereof.
   (c)   Prior to the suspension or revocation of any license, the Safety Director shall give the licensee written notice of such action. Within twenty days of such written notice, the licensee shall have the opportunity to correct, if possible, the deficiencies or conditions which provide the basis for the suspension or revocation.
