(a) No person shall feed, keep or harbor pigeons, ducks, mourning doves, doves, seagulls, geese or any other fowl of a similar nature in the City, so as to create thereby offensive odors or unsanitary conditions which are a menace to the health, comfort or safety of the public, or which creates unreasonably loud and disturbing noises of such character, intensity or duration, or at such unreasonable hours, as to disturb the peace, quiet and good order of the City.
(b) Whoever violates the provisions of division (a) of this section is guilty of a minor misdemeanor. If the offender previously has been convicted of a violation of division (a) of this section within one year of the commission of a new violation of division (a), the offender shall be guilty of a misdemeanor of the fourth degree.
