§ 150.45 ARTIFICIAL LOT DESIGNATION.
   (A)   If any building site is over two acres in size, the Code Enforcement Officer, at the request of any applicant for a permit to construct a new commercial building or parking lot, may designate an artificial lot to satisfy the requirements of this subchapter. No artificial lot may be designated by the Code Enforcement Officer unless it:
      (1)   Wholly includes the area on which construction work is to be done;
      (2)   Has an area that does not exceed 50% of the total area of all contiguous tracts or parcels under common ownership; and
      (3)   It includes all proposed buildings and structures, access drives, and appurtenant parking required for the new building construction.
   (B)   The Code Enforcement Officer shall designate an artificial lot encompassing the area on which construction work is to be done when, regardless of the size of the building site, a portion of the building site has been previously improved but the proposed new improvements would lie in a substantially unimproved area. If the portion of the building site which remains unimproved is less than two acres in size, then the entire remainder shall be included within the artificial lot.
