(A) A mobile food unit permit may be issued to authorize the operation of a push cart. Permits shall prohibit the operation of the push cart at any location that is within 100 feet of a food service business operating from a fixed location, without the written permission of those food service businesses operating from the affected fixed locations.
(B) Push carts with a valid permit may be operated from within a public street right-of-way, or upon a public sidewalk provided that vehicular and pedestrian traffic is not substantially impeded.
(C) Push carts that are in service shall be located on an improved surface such as concrete, rolled asphalt or permeable pavers.
(D) Push carts located within the downtown area will be limited as specified in an approved permit in conjunction with an approved city concessionaire agreement or on private property with the written consent of its owner.
