(A) A violation of any provision of this chapter shall be a civil violation, and shall be subject to penalties for each day the violation continues; provided, however, that, a second offense of said violation shall result in a mandatory minimum sanction of $100, and a third offense shall result in a mandatory minimum sanction of $250. Mandatory minimum sanctions shall not be waived, in addition to any other legal or equitable remedy to enforce the provisions of this chapter, the city may terminate or suspend water service to property owned or controlled by any party in violation. The City Manager or designee may cause a notice of water termination to be served upon the violating party stating that service will be discontinued in five days unless a hearing is requested, If a hearing is requested, the City Manager or designee shall convene a hearing within three days of the request. Upon finding that a violation has occurred, the City Manager or designee may order that water service be terminated or suspended pending compliance with this chapter.
