§ 56.150 AS-BUILT ENGINEERING PLANS.
   As-built drawings depicting actual construction shall be required for some permit types, as identified in the Technical Reference Manual. These drawings shall show any deviations from the approved engineering plans referenced in the permit. The as-built drawings shall be submitted in digital format. As-built drawings shall be the sole and exclusive property of the WCDOT. In the absence of as-built engineering plans of acceptable survey level detail, the county may request locating, in accordance with § 56.102(G).

§ 56.151 FINAL INSPECTION AND ACCEPTANCE.
   (A)   Upon written notification by the permittee, the resident engineer or the person in charge that the construction has been completed, including the submission of all required reports, the WCDOT shall perform a final inspection. Prior to final approval and acceptance by the WCDOT, the permittee shall correct any deficiencies noted by the WCDOT and provide one set of electronic as-builts for the WCDOT records, if required by permit type.
   (B)   At such time as all work has been done to the complete satisfaction of the WCDOT and the maintenance guarantee provided, the performance guarantee shall be released.
   (C)   WCDOT may restrict final inspections for release of the performance or maintenance guarantee between May 1 and November 1.

PERFORMANCE AND MAINTENANCE GUARANTEES,
AND INSURANCE REQUIREMENTS
§ 56.170 REQUIRED PRIOR TO PERMIT.
   Prior to the issuance of any permit for work to occur within a county highway right-of-way, the permittee shall provide sufficient financial guarantees and evidence of insurance to safeguard claims against the county for such work. Depending on the type and magnitude of the work, the financial guarantees shall consist of both performance and maintenance guarantees.

§ 56.171 PERFORMANCE GUARANTEES.
   (A)   An acceptable performance guarantee to protect the county highway system and ensure compliance with this chapter shall be provided prior to the issuance of a permit as provided for in this chapter.
   (B)   The performance guarantee shall be an irrevocable letter of credit for the following permit types:
      (1)   Major access.
      (2)   Temporary accesses for major earth work activities or prior to a permanent access.
      (3)   Minor access.
      (4)   Utility or facility permit which requires any open cut of county highway pavement.
   (C)   The performance guarantee shall be in the form of a cash bond, irrevocable letter of credit, or surety bond for all other types of permits.
   (D)   The County Engineer shall be and is hereby authorized to act for the county in all matters relating to performance guarantees.
   (E)   The County Engineer may accept a Letter of Agreement in lieu of a Letter of Credit for improvements performed or sponsored by a local agency.
   (F)   In the event an applicant applies for a temporary access to be constructed prior to execution of the permit for the permanent improvements, a Temporary Letter of Credit must be executed prior to execution of the temporary access permit. The amount of the Temporary Letter of Credit shall be 125% of an estimated cost submitted to and approved by the WCDOT for the conceptual permanent roadway improvements.
   (G)   The performance guarantee must contain the permit application number or the project name and county highway name on the guarantee. The amount and length of term of the performance guarantee shall be as identified in the Technical Reference Manual, based on the permit type.
