(A) Any person violating any provision of this chapter, for which no other penalty is provided, shall be subject to the penalty provisions of § 10.99.
(B) The County Board hereby declares that any employee who fails to comply with § 39.04 shall be subject to the following penalties.
(1) The county-owned cell phones shall be removed from the employee’s use and returned to the appropriate county office or department.
(2) The employee may be responsible for paying the entire monthly amount due for the cell phone usage. This amount may be deducted from the employee’s pay.
(3) The employee may be responsible for repairing and/or replacing any hardware or software in the county-owned cell phone that has been damaged in any way as a result of personal use.
(4) The employee may be liable for additional taxable income pursuant to § 280F(d)(4) of the Internal Revenue Code.
(5) Repeated failure to comply with this policy may subject the employee to disciplinary action.
