963.13   PUBLIC TREE CARE.
   (a)   The City shall have the right and responsibility, at its cost, to plant, prune, maintain and remove trees, stumps, plants and shrubs within the right of way of all streets, alleys, avenues, lanes, squares and public grounds, as may be necessary to insure public safety or to preserve or enhance the symmetry and beauty of such public grounds.
   The City Tree Commission may recommend to the City Manager the removal from the right of way of any tree or part thereof which is an unsafe condition or which, by reason of its nature, is injurious to sewers, electric power lines, gas lines, water lines or other public improvements, or is affected with any injurious disease, insect or other pest.
   (b)   Prior to the planting or removal of any tree, plant or shrub by the City, the property owner shall be given fifteen days written notice of the action to be taken and shall be provided an opportunity to appeal the decision to plant or remove the tree, plant or shrub to the City Manager. If the property owner is dissatisfied with the decision of the City Manager, the property owner may appeal to Council.
