1105.99 GENERAL BUILDING CODE PENALTY.
   (a)    Whoever fails or neglects promptly to notify the administrative officer having jurisdiction that work under a permit issued pursuant to the provisions of the Building Code has been started; or
   (b)    Whoever performs any construction work or installs any permanently placed or fixed device or equipment without first securing a permit required therefor under the provisions of the Building Code; or refuses, neglects or fails to secure any permit required under the provisions of the Building Code for the storage, use or handling of a hazardous substance; or blocks, wedge or otherwise hold in an open position any self-closing door required under the provisions of the Building Code to be maintained in a normally closed position; or
   (c)    Whoever perpetrates a fraud or misrepresents a material fact by reason of which any permit or approval required under the provisions of the Building Code is obtained; or pursues any trade or business or performs any work or service for which a license or certificate of registration is required under the provisions of the Building Code, without possessing such required valid license or certificate of registration; or
   (d)    Whoever refuses, neglects or fails to comply with an order to stop work issued under the provisions of the Building Code; or refuses, neglects or fails to comply with a notice to repair, rehabilitate or demolish a building or other structure declared to be unsafe under the provisions of the Building Code; or refuses, neglects or fails to comply with a notice requiring the abatement or removal of a violation or requiring compliance with any provision of the Building Code or any rule or regulation thereunder within the time limit set forth in such notice; or maintains a use or occupancy prohibited by the Building Code; or refuses, neglects or fails to maintain stair enclosures, stairways, fire escapes, exit passageways or other required means of egress in a safe and usable condition as required by the Building Code; or
   (e)    Whoever violates any other provision of the Building Code or any rule or regulations promulgated thereunder, except Section 1161.05(a), or who fails to comply therewith or with any order issued thereunder, or causes or permits the same to be done, is guilty of a misdemeanor of the first degree and shall be fined not more than one thousand dollars ($1,000) or imprisoned not more than six months or both. Each day during which noncompliance or a violation continues shall constitute a separate offense.
   (f)    The imposition of any penalty shall not preclude the Director of Law from instituting an appropriate action or proceeding in a court of proper jurisdiction to prevent an unlawful erection, construction, reconstruction, alteration, repair, conversion, maintenance or use, or to restrain, correct or abate a violation, or to prevent the occupancy of a building, structure or premises, or to prevent an illegal act, conduct, business or use, in or about any premises, or to require compliance with provisions of this Code or other applicable laws, ordinances, rules or regulations or the orders or determinations of the Commissioner of Buildings or the Board of Zoning Appeals.
