161.25 PHYSICAL EXAMINATIONS.
(a) A physical examination of all employees employed by or on behalf of the City is hereby required prior to commencement of employment. A physical examination may be required prior to any other person seeking employment with the City when the job description filed with the Civil Service Commission establishes a direct correlation between the services to be performed and the physical health of the applicant.
(b) A report of such physical examination shall be attached to and shall accompany each application for employment, and the expense of such examination shall be borne by the applicant.
(c) The City shall, in the case of provisional laborers hired in the event of an emergency, provide the aforesaid physical examination at the City's expense.
(d) No physical requirements shall be imposed unless the standard set is specifically related to job performance or personal safety of the worker, co-employees or the public. No physical requirement shall be imposed that is intended to frustrate the spirit or intent of the federal AAmericans with Disabilities Act of 1990".
(e) It shall be the policy of this City to comply with the AAmericans with Disability Act". (Hereafter referred to as AADA".)
(1) The City shall comply with the ADA by not discriminating against persons with disabilities protected under the Act. The City shall not discriminate in employment practices such as: recruitment, hiring, promotion, training, layoffs, pay, firing, job assignments, leave, and benefits.
(2) To be protected under the ADA, a person has a disability if he/she had a physical or mental impairment that substantially limits a major life activity.
(3) If an employee or job applicant is protected under the ADA, the City shall make reasonable accommodations to comply with the Act, unless, however, the accommodation would impose an undue burden on the City.
