141.10 PRIVATE POLICE.
   (a)    Private Police May Be Commissioned. The Director of Public Safety, pursuant to Ohio R.C. 737.05, is hereby authorized to commission private policemen and private policewomen not in the classified service of the City, to be known as special policemen and special policewomen, under such rules and regulations as hereinafter stated.

   (b)    Rules and Regulations; Bond; Fee. The Director of Public Safety is hereby authorized to prescribe rules and regulations for the conduct, control and the uniform which shall be worn by such private policemen and private policewomen wherever and whenever their services are conducted. Such private policemen and policewomen shall each give bond in the sum of one thousand dollars ($1,000) to the satisfaction of the Director of Public Safety and shall pay an annual fee of one dollar ($1.00) upon application, which fee and bond shall be renewed on September 1 of each succeeding year if commission is to be continued and all other requirements as hereinafter set forth have been met.

   (c)    Duration of Commission. No commission as private policeman or policewoman shall be valid for a greater period of time than one year from the date of issuance.

   (d)    Qualifications for Commission. 
      (1)    No person shall be a private policeman or private policewoman until an application has been filed with the Director of Public Safety and a license issued to such applicant by the Director of Public Safety. An applicant for such commission shall:
         A.    Be at least twenty-one years of age and a citizen of the United States of America;
         B.    Be able to read, write and speak the English language;
         C.    Be clean in dress and person, of good moral character and not addicted to the use of intoxicating liquors or drugs;
         D.    Produce, on forms to be provided by the Director of Public Safety, proof of good character from two reputable citizens of the City or Franklin County, who have known the applicant personally and can testify to that effect;
         E.    Fill out, upon a form to be provided by the Director of Public Safety, a statement giving age, residence, place of residence for five years previous to moving to his present address, race, height, color of eyes and hair, place of birth, length of time the applicant has resided in Franklin County, citizenship, place of previous employment, marital status, whether the applicant has been arrested or convicted of a felony or a misdemeanor, and such other information and data as the Safety Director may prescribe, not inconsistent herewith, and as may be necessary and reasonable.
      (2)    The Director of Public Safety may omit any of the above requirements if, in his opinion, sufficient reason is given for such omission.

   (e)    Uniform and Badge. The Director of Public Safety shall prescribe such uniform, badge and/or other distinguishing uniform marks for such private policemen or private policewomen as he may see fit in order to distinguish such private police officers from regular police officers of the Police Department.    (f)   Carrying of Firearms. The issuance of a private police commission shall not of itself constitute authority to carry firearms.

   (g)    Identification Card. An identification card shall be issued by the Director of Public Safety and such card shall be carried by such private policemen and private policewomen at all times while on duty in the City in order to identify him or her and to show for what purpose or purposes the commission has been issued.

   (h)    Nonliability of City. This section is declared by Council to be an exercise by the City of its police powers for the protection of public health, peace, property, safety and general welfare, and neither the City nor agent or a representative of the City, nor any individual, firm, partnership, corporation nor the trustees of any other agent thereof, who in good faith executes any executive order or rule or regulation promulgated pursuant to the provisions of this section shall be liable for injury or damage sustained to person or property as a direct or proximate result of such action.
