133.01 ASSISTANT CITY ATTORNEY.
   (a)   The City Attorney is authorized to appoint and hire an assistant to work under his direction and to perform such other duties as are required of such assistant by the City Attorney. The Assistant City Attorney shall serve at the pleasure of the City Attorney.
   (b)   The Assistant City Attorney is authorized to perform and exercise the powers and functions of the City Attorney only during the temporary absence from the City of the City Attorney, or because of the incapacity or physical disability of the City Attorney to serve, or during the interim when the position of the City Attorney is vacant for any of the reasons as set forth in Section 38 of the Charter. If the position of City Attorney is vacant for any of the reasons set forth in Section 38 of the Charter and the Assistant City Attorney must perform the duties of the City Attorney for an interim period before the City Council appoints a City Attorney under the provisions of Section 38 of the Charter, the Assistant City Attorney shall receive compensation at the rate prevailing for the most recent City Attorney for services during that interim period.
