517.44 PORTABLE ATHLETIC DEVICES PROHIBITED.
   (a)   All portable athletic devices including but not limited to, basketball hoops and backboards, are not permitted to be erected on City property, including all easements, rights-of- way, public streets and sidewalks.
   (b)   The installation/placement of portable athletic devices such as basketball hoops or backboards on private property is permitted provided the activity created by said devices will not take place on public streets, sidewalks and rights-of-way.
   (c)   In the event of a violation of this section, notice shall be given to any homeowner or resident in violation of this section by either the Code Enforcement Officer or the Whitehall Police Department to remove such devices immediately.
   (d)   Whoever violates any provision of this section is guilty of a minor misdemeanor on a first offense; on a second offense, the person is guilty of a misdemeanor of the fourth degree; and on each subsequent offense, the person is guilty of a misdemeanor of the third degree. If, on a second offense or more within one year the athletic device is not removed within a reasonable period of time, the City may impound such device.
