763.01 DEFINITIONS.
   For the purpose of this chapter the following definitions shall apply unless the context clearly indicates or requires a different meaning.
   (a)    “Hotel” means any structure consisting of one or more buildings with five (5) or more guest rooms kept, used maintained or held out to the public to be a place where sleeping accommodations are offered for pay to transient guests for a period of thirty (30) days or less in which access to each guestroom is provided by interior hallways.
   (b)   "Extended Stay Hotel" means those facilities specifically constructed, kept. used, maintained, advertised or held out to the public to offer temporary residence to persons either relocating their residence to the area or on temporary work assignment in the area. For purposes of this chapter, all references to "hotel" include extended stay hotels.
   (c)    "Motel" means a building or group of buildings providing five (5) or more guestrooms used for transient guests for a period of thirty days or less in which access to each guest room is provided directly through an exterior door or by an entrance connected to a covered hallway or walkway on the exterior of the building.
   (d)    "Owner " means any person, operator, firm or corporation, or an agent of any person, operator, firm or corporation who is authorized to act on the owner's behalf, and being one or more of the following:
      (1)   Having a legal or equitable interest in the property;
      (2)   Recorded in the official records of the State, County, or Municipality as holding title to the property; or
      (3)   Otherwise having control of the property, including the guardian of the estate of any such person and the executor or administrator of the estate of such person if ordered to take possession of real property by a court.
   (e)    "Employee" means any person working in the hotel or motel, including clerks, managers, housekeeping staff and maintenance personnel.
   (f)    "Utensils" means drinking glasses, pitchers, and other equipment that is designed to come into contact with potable water, food or beverages during storage, transportation, washing, serving or normal usage.
   (g)   "Code Enforcement Officer" means that person or persons authorized by the City to enforce the provisions of this chapter.
   (h)    "Premises" means the site upon which the hotel or motel is located, including the land and all buildings.
   (i)    "Establishment" means a hotel or motel.
