333.09 OPEN CONTAINER WITHIN MOTOR VEHICLES.
(a) No person shall have in his possession an open container of beer or any other intoxicating liquor in a motor vehicle upon a street or highway within the City.
(b) No person shall have in his possession an open container of beer or any other intoxicating liquor when in or on a stationary motor vehicle on any street, highway or other public or private property open to the public for purposes of vehicular travel or parking.
(c) As used in this section, “street”, “highway” and “motor vehicle” have the same meanings as in Ohio R.C. 4511.01.

(d) Whoever violates this section is guilty of a misdemeanor of the fourth degree.
