903.06 SIDEWALK CONSTRUCTION; CERTIFICATE OF OCCUPANCY OR BOND. 
   Sidewalks shall be constructed before a certificate of occupancy is issued.
   (a)    If the season is such that concrete cannot be laid, then a certificate of occupancy may be issued after the posting of a bond. The applicant shall post a cash bond in the sum of five dollars ($5.00) per foot of lot dimension abutting any improved public street whether such street abuts on the front or side of such lot. Such bond shall be posted with the City Auditor.
   (b)    Such bond shall be returned after sidewalks have been constructed to the City's specifications. After inspection and his approval, the Director of Public Service shall issue a certificate of completion which certificate shall be given to the Auditor who shall return the bond to the applicant.
   (c)    In the event the applicant for the building permit fails to construct such sidewalks and driveway approaches within one year of the time such bond is posted, the Director shall cause such sidewalks and driveway approaches to be constructed using the bond as payment thereof. If the cost of such construction exceeds the amount of the bond, the remainder of the costs shall be assessed to the property owner by certification to the County Auditor.
   (d)    Subsections (a), (b) and (c) hereof may be waived by the Director whenever construction of sidewalks and/or driveway approaches would create unnecessary hardship on the property owner or where such requirements would be unreasonable. Upon refusal of the Director to waive such provisions upon request, the property owner may appeal to the Board of Building and Zoning Appeals. Such appeal shall be heard without prior advertising and the Board shall give prompt attention to such appeal.
