737.01 LICENSE REQUIRED.
Vendors or peddlers selling or offering for sale ice cream, frozen desserts, soft drinks, candy, sandwiches, nuts, novelty confections and/or similar foodstuffs on public rights of way within the City shall obtain a license from the City prior to engaging in such selling or offering for sale, such license to be issued by the office of the Mayor. Current licenses shall expire on May 31 of each year and will require a new license thereafter. The application shall set forth the following information:
(a) The name and permanent home address of the applicant at the time of the application.
(b) A description of the vehicle to be used, including:
(1) The name and address of the owner of the vehicle as registered with the Department of Motor Vehicles.
(2) A description of the vehicle, giving the name of the manufacturer and VIN number.
(3) If the applicant is not the owner, the name of the individual and/or company that owns the vehicle.
(4) The applicant shall submit a background check dated no earlier than 30 days prior to submitting the application. A license will not be issued until the applicant passes the background check.
(c) If the applicant is an employee or representative of any person, there shall be appended to the application a letter from the employer or principal authorizing the applicant to act as his representative.
(d) The employer or principal of the street vending company supplying the vehicle is required to register new or additional drivers throughout the year.
Such license may be revoked for failure of the licensee or his/her agents to comply with the terms of this chapter.
As deemed appropriate by the Mayor, the Mayor may rescind license requirements for such activities as City and/or community sponsored events and festivals.
