545.17 PEEPING AND PROWLING.
   (a)    No person shall, without authorization of the owner, tenant or person in possession of any building, spy, look into or watch any action of any person in any building whether on public or private property without lawful business if by doing so he invades the right to privacy of the owner, tenant or person in possession of the building. No person not having a legal right to do so shall place himself in a position to do any of the acts described in this subsection.
   (b)    Any person on property not his own found looking into or viewing the interior of a residence or dwelling in which he is not a member of the family so inhabiting the residence or dwelling, shall be presumed to be guilty of violating this section if the person is standing within ten feet of the residence or dwelling into which he is found looking or viewing the interior thereof.
   (c)    The provisions of this section shall not apply to the actions of a peace officer as defined in Ohio R. C. 2935.01 and while such peace officer is in pursuit of his official duties.
   (d)    Whoever violates this section is guilty of a misdemeanor of the fourth degree.
