525.02 HOURS OF CURFEW FOR MINORS UNDER EIGHTEEN.
(a) No minor under the age of eighteen shall loiter, idle, wander, stroll or play in or upon the public streets or other public places during the period between 11:00 p.m. and 4:30 a.m. unless accompanied by the minor’s parent or guardian, or unless such a minor is on an emergency errand directed by the minor’s parent or guardian or legitimate business directed by the minor’s parent, guardian or other adult person having the care and custody of the minor.
(b) No minor under the age of eighteen shall loiter, idle, wander, stroll or play in or upon private property, except upon private property where the minor resides, without the permission of the minor’s parent or guardian during the period between 11:00 p.m. and 4:30 a.m.
(c) No minor between and including the ages of six and seventeen years, shall be upon or about the public streets, public places, commercial establishments or places of amusement or entertainment within the City during the school hours throughout the academic school year, except where one of the following applies:
(1) The child is accompanied by a parent, guardian or person having legal custody and control of that child.
(2) The child is employed pursuant to ages and schooling certificate, during the actual working hours or traveling directly to or from the job site.
(3) The child is on a verifiable emergency errand or legitimate business directed by the minor’s parent or guardian or other adult person having the care and custody of the minor.
A. Legitimate business includes but is not limited to home schooling, Charter schools, an excused absence, approved late start or early release from school, travel between school buildings as required for vocational school, college classes or Basic Career Instruction Program.
(d) No minor between and including the ages of six and seventeen years shall loiter, idle, wander, stroll or play in or upon private property, except upon private property where the minor resides or receives daycare without the permission of the minor’s parent or guardian and the owner, tenant, or lessee of the private property during the school hours throughout the academic school year.
(e) A child who violates subsections (c) and (d) hereof is guilty of being an unruly child in accordance with Ohio R.C. 2151.022.
(f) A child who violates subsections (c) and (d) hereof shall be taken into custody under the authority of Ohio R.C. 2151.21(A)(6)(a) and the child shall then be processed and released within the statutory guidelines set forth in Ohio R.C. 2151.311 and 2151.312.
(g) Whoever violates this section is guilty of a misdemeanor of the fourth degree.
