517.43 WATER EMERGENCY. 
   (a)    The Mayor is hereby authorized within his discretion and judgment to declare a "Water Emergency" upon his finding that a supply or distribution problem exists within the City of Whitehall water distribution system or within the City of Columbus Division of Water.
   (b)    The Mayor shall declare such "Water Emergency" by proclamation, and the Mayor shall set forth the restrictions and regulations on the usage of water provided through the City of Whitehall and City of Columbus water distribution system in such proclamation.
   (c)    Any "Water Emergency" declared and proclaimed by the Mayor shall remain in effect for a period of 215 days from the date of its issuance, and may be terminated or may be temporarily suspended at any time by the Mayor. Upon expiration of any such "Water Emergency", the Mayor may proclaim a new "Water Emergency" as set forth above.
   (d)    No person shall fail to obey the restrictions on usage of water as set forth in the "Water Emergency" proclamation, and no person shall fail to obey the lawful order of any police officer or employee of the City of Whitehall or the City of Columbus, which is issued in the enforcement of the restrictions of such "Water Emergency".
   (e)    Whoever violates this section shall be guilty of a minor misdemeanor for the first offense, or a misdemeanor in the fourth degree for the second and subsequent offenses within a period of one year. (Ord. 36-92. Passed 4-21-92.)
