339.07 TRUCK ROUTES.
   (a)   No person, firm, partnership or corporation shall operate any intrastate or interstate truck designed to haul or carry property with a gross weight in excess of seven tons on any of the streets in the City with the exception of East Broad Street, East Main Street and Hamilton Road, and with the following exceptions:
      (1)   This section shall not apply to emergency equipment of the Police or Fire Departments or Street Maintenance Department of the City.
      (2)   This section shall not apply to trucks light in weight commonly referred to as panel body trucks, pickup trucks and trucks whose maximum legal capacity does not exceed the designated gross weight of the vehicle as stated by this section.
      (3)   No person shall operate any excluded truck in violation of markings, signs, barriers or other devices, except this section shall not apply to any truck which enters any of such streets for the purpose of making delivery on the street upon which it is operating or a connecting cross street, or which enters such street for the purpose of picking up loads or parts of loads upon the street upon which it is operating or upon a connecting cross street, and then only when entering and leaving such street by the nearest intersecting street so marked.

   (b)   Whoever violates any provision of this section is guilty of a minor misdemeanor on a first offense; on a second offense within one year after the first offense, the person is guilty of a misdemeanor of the fourth degree; on each subsequent offense within one year after the first offense, the person is guilty of a misdemeanor of the third degree.
