191.06 SEPARATE DOCKETS FOR CRIMINAL AND CIVIL ACTIONS; RECORDS.
   The Court shall provide and keep separate dockets of all criminal and civil actions coming before it and shall keep a record of its proceedings.

191.07 COLLECTION OF FEES, FINES AND FORFEITURES; TRANSMISSION TO FINANCE DIRECTOR.
   The Clerk of the Municipal Court shall be responsible to collect all fees, fines, costs and forfeitures imposed by the Court and shall transmit the same to the Finance Director daily.

191.08 JURY TRIAL.
   Any defendant in jeopardy of incarceration in any misdemeanor proceeding before the Municipal Court shall be entitled to a trial by jury unless such defendant shall affirmatively waive, in writing, such right; provided, however, the Municipal Court Judge, in his/her discretion, may signify on the docket in advance of trial that under no condition will a jail sentence be imposed, and the foregoing waiver shall not be required and the defendant shall not be entitled to a trial by jury.

191.09 IMPOSITION OF REQUIRED COURT COSTS.
   (a)   In addition to any other costs which may be lawfully imposed, the Municipal Court Judge shall impose those court costs as may be required from time to time by applicable law in each proceeding.
   (b)   The Clerk of the Municipal Court or such person designated to receive fines and costs shall remit any such required costs in the manner proscribed by applicable law.

191.10 PAYMENT BY CREDIT CARD; PAYMENT PLAN; SUSPENSION OF LICENSE.
   The provisions of West Virginia Code 8-10-2a and 8-10-2b, as may be amended or otherwise modified from time to time, pertaining to the payment of fines and costs are hereby incorporated by reference as though fully set forth herein. A copy of the present West Virginia Code 8-10-2a and 8-10-2b are attached to original Ordinance 11762.
