1105.01 APPROVAL CRITERIA.
   The approval for a minor subdivision as defined in Section 1101.03(a)(1) shall be granted where the following criteria are fulfilled.
   (a)   The submission of a proposed deed with a description following a survey completed by a Registered Surveyor licensed in the State of Ohio, showing the boundary line of the property to be deeded, the tract designation or other description according to the real estate records of the Williams County Auditor’s Office, accurate in scale, the names and location of all existing or proposed roads or other ways within or adjacent to the proposed tract, and the name and address of the surveyor.
   (b)   If the tract is to be used as a building site, written evidence from the Village Administrator showing the availability of sanitary sewers to the proposed tract, must be submitted.
   (c)   If the tract is to be used as a building site, written evidence of the purchaser’s awareness of and proposed resolution of any potential drainage problems on the property, must be submitted.
   (d)   If the tract is to be used as a building site, the building may not be in a flood plain or existing natural watercourse. The flood plain is defined as any property consisting of flood plain soil as shown on the soil photomaps of Williams County, produced by the U.S.D.A. Soil Conservation Service. If there is a showing by the applicant that the tract in question is not subject to flooding within a one hundred (l00) year return period, this condition shall be met.
   (e)   The minimum lot size shall conform to the zoning regulations of the Village of West Unity, Ohio.
   (f)   The proposed deed must also contain the grant, if necessary, of an easement to the Village of West Unity for the purpose of street right-of-way and utility purposes in conformity with Table 1 of the Subdivision Regulations.

   (g)   If the Planning Commission through its designated representative, the Village Engineer, is satisfied that such proposed division is not contrary to applicable platting, subdividing or zoning regulations it shall within seven working days after submission approve such proposed division and, on presentation of a conveyance of said parcel, shall stamp the same “Approved by Planning Commission; No Plat Required” and have it signed by the Village Engineer.
