Upon the failure of any permit holder of the first class to make such repairs hereinbefore mentioned in the manner or in the time required, the Street Commissioner is empowered and authorized to cause such repairs to be made and such public place to be restored to its original condition, and the cost thereof, plus 10% thereof, shall be charged to and paid by such permittee who so fails to make such repairs, and such sum of money shall constitute and be a debt due from such permittee to the city, and in addition to any other remedy fixed by law, an action shall lie upon his or her bond against the principal and sureties or surety, who shall be liable jointly and severally.
