(A) All persons in the second class, upon making application for an excavation permit, shall pay to the City Treasurer a sum of money to be based upon the square yards of surface of such public place to be removed, to be determined by the City Treasurer as provided in a schedule to be prepared by the Street Commissioner and approved by resolution of the Common Council; and such schedule shall provide for a deposit adequate in each instance to backfill the excavation, restore the surface to as good condition as it was prior to making the excavation, install and maintain barriers, lights, and other safeguards should the permit holder fail to do so, to remove and dispose of any rubble that may remain after the work of restoration has been completed, and to reimburse the city for any additional expense that may be incurred by it and incidental to the permit. In the preparation of any such schedule, the cost of materials and labor for the several types of paving used in the city shall be given due consideration.
(B) Until such schedule has been prepared and approved as hereinabove provided, the amount of deposit shall be determined as in the manner prescribed in pertinent ordinances in effect immediately preceding the effective date of this code.
(C) The City Treasurer shall make, and provide to each depositor, his or her written receipt for each deposit made pursuant to this section.
