§ 154.063 ACTION ON APPLICATIONS; GRANTING PERMITS; APPEAL TO COMMON COUNCIL WHEN DENIED.
   Upon receipt of an application for an excavation permit, the Street Commissioner shall without delay either grant or deny such permit, but in the absence of the Street Commissioner, the application may be delivered to the Mayor, who shall either grant or deny the permit applied for and, in either case, upon rejection of the application, the applicant shall have the right to present the matter to the Common Council, the order of which shall be final in such matter, and upon final rejection any deposit of money shall be returned to the depositor thereof.
