§ 132.10 REGISTRATION FOR PLACING OR MAINTAINING COMMUNICATIONS FACILITIES IN PUBLIC RIGHTS-OF-WAY.
   132.10(A)   Registration required. A , Cable or or certificate holder that desires to place or maintain a   in the shall first register with the in accordance with this Section. Subject to the terms and conditions prescribed in this Chapter, a may place or maintain a   .
   132.10(B)   Scope of registration. A registration shall not convey any title, equitable or legal, . Registration under this Chapter governs only the placement or maintenance of   . Registration does not excuse a , Cable or from obtaining appropriate access or   agreements before locating its facilities on the ’s or another ’s facilities. Registration does not excuse a , Cable or from complying with all applicable , including ordinances, codes or regulations, including this Section.
   132.10(C)   Required information. Each , Cable or that desires to place or maintain a   in the shall file a single registration with the that shall include the following information:
   132.10(C)(1)   Name of the ;
   132.10(C)(2)   Name, address and telephone number of the ’s primary contact in connection with the registration and of the to contact in case of an ;
   132.10(C)(3)   A copy of federal or certification authorizing the to do business in the of Florida and to provide service in the ;
   132.10(C)(4)   Acknowledgment that has received and reviewed a copy of this Chapter, and, when applicable, the current tax rate established by the ;
   132.10(C)(5)   Evidence of the insurance coverage and submission of a security fund when required by this Section.
   132.10(D)   Effectiveness. The shall review the information submitted by the . If the submits information in accordance with subsection 132.10(C), the registration shall be effective and the shall notify the of the effectiveness of registration in writing. The effectiveness of a registration shall not relieve the of the obligation to obtain any and all necessary permits before any work is commenced If the determines that the information has not been submitted in accordance with subsection 132.10(C) above, the shall notify the in writing of the non-effectiveness of registration, and reasons for the non-effectiveness. The shall so notify an within 30 calendar days after receipt of registration information from the .
   132.10(E)   Cancellation. A may cancel a registration upon written notice to the that the will no longer place or maintain any   and will no longer need to obtain permits to perform work . A cannot cancel a registration if the continues to place or maintain any   .
   132.10(F)   Nonexclusive registration. Registration shall be nonexclusive. Registration shall not establish any right or priority to place or maintain a in any particular area within the   are expressly subject to any future amendment to or replacement of this Chapter and further subject to any additional ordinances, as well as any or federal Laws that may be enacted.
   132.10(G)   Renewal and change of registration information. By April 1 of even numbered years, a shall renew its registration in accordance with the registration requirements in this Chapter. Within 30 calendar days of any change in the information required to be submitted pursuant to subsection 132.10(C), a shall provide updated information to the . If no information in the then-existing registration has changed, the renewal may state that no information has changed. Failure to renew a registration may result in the restricting the issuance of additional permits until the has complied with the registration requirements of this Chapter.
   132.10(H)   Permit required. In accordance with applicable ordinances, codes or regulations and this Chapter, a permit shall be required of a , Cable or that desires to place a   . An effective registration shall be a condition of obtaining a permit. Notwithstanding an effective registration, permitting requirements shall continue to apply.
