3-2-6: ISSUANCE OF LICENSES:
The procedure to be followed by the local liquor control commission at the annual meeting on the third Monday in April for issuance of alcoholic liquor licenses shall be as follows:
   A.   The local liquor control commission shall first grant or deny an alcoholic liquor license to each renewal applicant pursuant to the procedure and criteria set forth in section 3-2-5 of this chapter.
   B.   When the local liquor control commission has granted or denied each applicant for a renewal license, they shall determine whether any alcoholic liquor licenses are available for new applicants.
   C.   In the event that no such licenses are available, the local liquor control commission shall so indicate by motion.
   D.   In the event that a license or licenses remain available, the local liquor control commission shall consider the new applications in the order received by the village manager.
   E.   If the total number of available licenses is equal to the total number of new applicants, the local liquor control commission shall grant or deny an alcoholic liquor license to each new applicant pursuant to the procedure and criteria set forth in section 3-2-5 of this chapter and subsection D of this section.
   F.   If the total number of new applicants exceeds the total number of available licenses, the local liquor control commission shall review all new applications pursuant to the procedure set forth in section 3-2-5 of this chapter prior to the granting or denying of any new licenses. Thereafter, the local liquor control commission shall grant or deny an alcoholic liquor license to each new applicant in the same order in which said applicants were reviewed, pursuant to the procedure and criteria set forth in section 3-2-5 of this chapter and subsection D of this section.
   G.   All renewal and/or new licenses granted by the local liquor control commission shall not be issued until the licensee complies with the insurance provisions set forth in subsection 3-2-10G of this chapter. (Ord. 89-04, 4-3-1989)
