ADOPTING ORDINANCE
ORDINANCE NO. 04-04
   An Ordinance Amending the West Dundee Municipal
   Code Under the Home Rule
   Powers of the Village of West Dundee
   WHEREAS, the Village of West Dundee, Kane County, Illinois, has previously passed by ordinance the West Dundee Municipal Code and subsequent amendments; and
   WHEREAS, it is the desire of the Village of West Dundee to amend the West Dundee Municipal Code; and
   WHEREAS, the Village of West Dundee, Kane County, Illinois, is a home rule municipality as contemplated under Article VII, Section 6, of the Constitution of the State of Illinois, and the passage of this Ordinance constitutes an exercise of the Village's home rule powers and functions as granted in the Constitution of the State of Illinois; and
   WHEREAS, the President and Board of Trustees find that due to exigent circumstances, this Ordinance shall take effect immediately upon its passage.
   NOW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees of the VILLAGE OF WEST DUNDEE, Kane County, Illinois, as follows:
   SECTION 1: That all provisions contained in the West Dundee Municipal Code, attached hereto and made a part hereof, are hereby amended to reflect the changes incorporated herein.
   SECTION 2: That all of the provisions contained in the West Dundee Municipal Code that are the subject of this Ordinance which are not being amended, shall be construed to be a continuation of existing Village ordinances and shall not be interpreted as new enactments. Moreover, all amendments shall take effect immediately. However, the prior ordinances shall survive insofar as necessary to carry out any enforcement actions for violations occurring prior to the date of this Ordinance.
   SECTION 3: If any section, paragraph, subdivision, clause, sentence or provision of this Ordinance shall be adjudged by any Court of competent jurisdiction to be invalid, such judgment shall not affect, impair, invalidate or nullify the remainder thereof, which remainder shall remain and continue in full force and effect.
   SECTION 4: All ordinances or parts of ordinances in conflict herewith are hereby repealed to the extent of such conflict.
   SECTION 5: This Ordinance shall be in full force and effect immediately upon its passage. Publication in pamphlet form is hereby authorized as provided by law.
