3-2-5: REVIEW OF APPLICATIONS:
   A.   All new and renewal alcoholic liquor license applications which have been filed at the Village Hall with the Village Clerk or Deputy Village Clerk between March 1 and April 1, both dates inclusive, and received by the Village Manager as provided herein will be considered at the next annual meeting of the Local Liquor Control Commission on the third Monday in April.
   B.   The Village Manager shall review each application which is filed at the Village Hall with the Village Clerk or Deputy Village Clerk and shall determine when an application is received by reviewing whether each and every one of the questions thereon has been answered, the signatures of the applicant have been sworn or notarized, the appropriate fee has been paid by cashier's or certified check, and whether the appropriate surety bond has been posted. The review by the village manager shall be within five (5) working days after all of the above has been filed. The village manager shall thereafter notify each applicant in writing as to when his or her application has been received and when it will be reviewed by the local liquor control commission, or notify the applicant as to the additional material or materials which must be filed before the application can be considered received. Prior to the annual meeting of the local liquor control commission on the third Monday in April, the village manager shall prepare a written list showing the order of receipt for both renewal and new applications.
   C.   The local liquor control commission shall review all alcoholic liquor license applications in the following order:
      1.   Renewal applications will first be considered in the order received by the village manager as set forth in subsection B of this section.
      2.   New applications will next be considered in the order received by the village manager as set forth in subsection B of this section.
   D.   The local liquor control commission shall consider the following criteria in addition to the sworn application when reviewing an applicant for the renewal of an alcoholic liquor license:
      1.   Whether the applicant has violated or continues to violate any of the laws of the state of Illinois or ordinances of the village of West Dundee regarding the sale or distribution of alcoholic liquor during the preceding license term.
      2.   Whether the applicant has violated or continues to violate any of the laws of the state of Illinois or ordinances of the village of West Dundee during the preceding license term.
      3.   Whether the applicant owes any outstanding fees, fines and/or monies to the village of West Dundee.
      4.   Whether the applicant is qualified to receive an alcoholic liquor license pursuant to 235 Illinois Compiled Statutes, as amended.
      5.   Whether any alcoholic liquor license is presently available to the renewal applicant in the event that the village of West Dundee has reduced the total number of licenses to be issued.
      6.   Whether the public good, convenience, health, safety and morals will be furthered by the granting of an alcoholic liquor license to the applicant.
   E.   The local liquor control commission shall consider the following criteria in addition to the sworn application when reviewing an applicant for a new alcoholic liquor license:
      1.   Whether the applicant has violated or continues to violate any of the laws of the state of Illinois or ordinances of the village of West Dundee regarding the sale or distribution of alcoholic liquor during the preceding license term.
      2.   Whether the applicant has violated or continues to violate any of the laws of the state of Illinois or ordinances of the village of West Dundee during the preceding license term.
      3.   Whether the applicant owes any outstanding fees, fines and/or monies to the village of West Dundee.
      4.   Whether the applicant is qualified to receive an alcoholic liquor license pursuant to the liquor control act of 1934 1 as amended.
      5.   Whether any alcoholic liquor licenses are presently available for new applicants after the issuance of renewal licenses or a reduction in the total number of licenses to be issued.
      6.   Whether the public good, convenience, health, safety and morals will be furthered by the granting of an alcoholic liquor license to the applicant.
      7.   Whether any additional alcoholic liquor licenses are available to new applicants pursuant to a valid and binding annexation agreement between the village of West Dundee and another party or parties as authorized by 65 Illinois Compiled Statutes 5/11-15.1-1 and 11-15.1-2.
   F.   Applications for new alcoholic liquor licenses may also be filed during the license term for the remainder of the license term. Said applications shall be filed as set forth in subsection B of this section. The full amount of the annual license fee must accompany such an application. The application review and issuance shall occur pursuant to the criteria and procedure set forth herein. (Ord. 89-04, 4-3-1989)
