7-2-44: ABATEMENT OF DANGEROUS SIDEWALKS:
The owner or occupant of any lot or premises, where any holes or loose planks or other defects are permitted or allowed to be and remain in and about the sidewalks in front of or adjacent to his premises, as referred to in Section 7-2-43 hereof, is hereby required to repair such defects and abate such nuisances without delay; and in default thereof, it shall be the duty of the Superintendent of Water and Streets to abate the same; and if any person shall recover any judgment against the City because of injury resulting from such defects or nuisance, the owner or occupant of the premises where such injury was sustained shall be liable in an action of debt, for the full amount of the damages and costs so recovered against the City.
