§ 115.99 PENALTY.
   (A)   Any person violating any provision of this chapter for which no specific penalty is prescribed shall be subject to § 10.99 of this code of ordinances.
   (B)   Whoever violates § 115.02 shall be guilty of a first degree misdemeanor.
   (C)   Whoever violates §§ 115.08 through 115.11 or 115.12 shall be guilty of a third degree misdemeanor for the first offense and shall be guilty of a first degree misdemeanor for subsequent violations occurring within five years. In addition to any other penalty permitted by law, if an offender is convicted of a first degree misdemeanor as provided in this division (C), the court shall impose a suspension of the swap shop/secondhand dealer’s license for a period of not less than 60 nor more than 180 days.
   (D)   Whoever violates §§ 115.04 or 115.05 shall be guilty of a fourth degree misdemeanor.
   (E)   A separate offense shall be deemed committed upon each day during or on which the violation occurs or continues to occur.
   (F)   (1)   Whoever violates this section shall be fined not less than $25 nor more than $1,000 and the costs of prosecution.
      (2)   Whoever fails to comply with or violates § 115.14 is guilty of a misdemeanor of the first degree. If the offender one time previously has violated or failed to comply with § 115.14, the violation or failure is a felony of the fifth degree. If the offender two or more times previously has violated or failed to comply with § 115.14, the violation or failure is a felony of the fourth degree.
