1329.07  VIDEO LOTTERY ESTABLISHMENTS.
   The City of Wellsburg’s City Council believes that the proliferation of video lottery establishments throughout the City must be subject to certain zoning restrictions so that such establishments are not so closely located as to dominate one particular locality to the near exclusion of other business establishments; are not located in close proximity to schools, churches, public parks or residential neighborhoods.  The City believes that such proliferation is detrimental to the health, safety and welfare of the community.  Further, Council believes that it is reasonable to place zoning restrictions upon establishments providing for video lottery terminals so that concerns such as traffic, parking provisions, character of the surrounding neighborhood, goals of the Comprehensive Plan and distance requirements can be addressed prior to such establishment being given approval to operate and a license to do business within the City.
   (a)   General Requirements for Establishments Providing Video Lottery Terminals:
      (1)   No such establishment is permitted in any residential zone of the City.
      (2)   No such establishment is permitted within 600 feet of another such establishment already providing video lottery or having a license to do so.
      (3)   No such establishment is permitted within 600 feet of a school that is part of a public or private school system.
      (4)   No such establishment is permitted within 600 feet of a church.
      (5)   No such establishment is permitted within 600 feet of a municipally owned public park.
   (b)   For the purpose of this section, distance shall be measured in a straight line, without regard to intervening structures or objects, from the nearest portion of the parcel of real estate upon which an establishment providing video lottery is located to the nearest property line of the premises of a church, a public or private school, or a public park.
   (c)   Any permits and Video Lottery Business Licenses shall not issue until the zoning officer has confirmed the general distance requirements in subsection (a) are met.
