1329.04  OTHER MISCELLANEOUS USES.
   (a)   Animal Hospital and Boarding Kennels.  Such use shall be located no closer than 250 feet to any residential dwelling, restaurant or hotel in any district where permitted, and shall show that adequate measures and controls have been taken to prevent offensive noise and odor.  No incineration or refuse shall be permitted on the premises.
   (b)   Home Occupations.  A home occupation shall be an incidental use of the dwelling unit conducted only by residents of the building, who may not employ more than three additional nonresident persons.  The following additional conditions shall be fulfilled:
      (1)   Where permitted.  Within a single dwelling unit or in an accessory building, provided that only one home occupation per dwelling unit shall be permitted.
      (2)   Evidence of use.  No external evidence of the home occupation shall be permitted, with the exception of a nonflashing sign not exceeding one and one-half square feet in area.
      (3)   Permitted uses.  Not more than one each per residence of the following:
         A.   Medical, dental and other professional, real estate, insurance and other similar offices, not to include barber or beauty shops, in accordance with the provisions for off-street parking.
         B.   Rooming and/or boarding of not more than two persons, not to include the rooming, boarding and/or care of diseased or mentally ill persons.
         C.   Custom dressmaking, tailoring, millinery.
         D.   Foster family care for not more than four children simultaneously.
         E.   Tutoring for not more than four students simultaneously, but not including music, dancing, or business schools, or similar activities.(5-16-67)
         F.   Bed and breakfast inn, being defined as a use which is subordinate to the principal use of a dwelling unit as a single family dwelling, in which transient guests are provided a sleeping room and breakfast meal accomodations in return for payment or other consideration; provided, the following specific rules and requirements shall govern the operation of a bed and breakfast inn:
            1.   The subject premises shall also be the primary residence of the owner/operator.
            2.   Meals shall be served only to registered guests of the inn.
            3.   The number of guest rooms shall be limited to four, or to such greater number of bedrooms as were originally constructed in the subject house and which remained as of the date of enactment of this subsection.
            4.   One off-street parking space shall be provided for each guest room.
            5.   The inn shall be equipped with one or more private bath facilities for the guests, separate and apart from those of the owner/operator.
            6.   Notwithstanding the above limitation of subsection (b)(2), a bed and breakfast may have a single nonilluminated sign not exceeding three square feet, which sign shall not include the words "hotel" or "motel", and shall be affixed to the building.  For inns which are not readily visible from the public street, a second nonilluminated sign not exceeding three square feet may be used in a location as necessary to direct guests to the inn.
            7.   Each guest room shall be provided with a smoke detector alarm, and the inn shall be equipped with a second access to and from the building for suitable emergency escape.
            8.   Guests may stay no longer than forty-five days during the course ofa single calendar year, provided this rule shall have no application to relatives of the owner/operator.
            9.   Inns may be established only in those residential structures having historic significance as shown by registration on a state or national historic register, or reliable evidence that the building is at least fifty years of age.  For buildings of less than fifty years of age or not registered, such building must be similar in architectural character and design as the oldest remaining structures in the immediately contiguous and surrounding blocks of the neighborhood, in order to promote preservation and use of significant older buildings rather than relatively newer buildings having less historical significance.
            10.   All decisions concerning compliance with the above criteria shall be made in the first instance by the zoning officer.  In the event of disagreement regarding a decision made on an application, the applicant may appeal to the Board of Zoning Appeals; provided, no variance shall be granted until review and recommendation upon the application by the Planning Commission prior to hearing upon a variance request before the Board of Zoning Appeals.
            11.   Issuance of a zoning permit to conduct a bed and breakfast home occupation shall not relieve the operator from obtaining all other required business licenses or permits from state or local agencies having jurisdiction.

   (c)   Junkyards, Including Automobile Wrecking.  No new junkyards shall be permitted within the City limits from the date of passage of this section.  Such uses existing at such time may continue their operations as nonconforming uses, but shall terminate within one year unless they comply with the following provisions:
      (1)   All junkyards shall be completely enclosed by a fence or wall at least six feet in height, which completely screens its contents from the public.
      (2)   No highly inflammable or explosive material shall be stored in bulk above ground, with the exception of fuel tanks or drums which are directly connected with heating appliances.
      (3)   All materials or wastes causing fumes or dust, constituting a fire hazard, or attractive to rodents or insects, may be stored outdoors only in enclosed containers.
      (4)   Such yards are licensed in accordance with the ordinance on junkyards.
   (d)   Commercial Buildings in C-1 District and C-2 District.  A commercial building may be constructed in the C-1 District or the C-2 District along Commerce Street or Charles Street providing that it complies with the following:
      (1)   Such lot abuts on Commerce Street or Charles Street.
      (2)   Such building fronts toward Commerce Street or Charles Street.
