762.99  PENALTY.
   (a)   It shall be unlawful for any person to violate any provision of this article; and whoever violates any provision of this article shall be fined not more than five hundred dollars ($500.00).  A person convicted of a second or subsequent offense under this article, shall be fined not less than five hundred dollars ($500.00) and not more than one thousand dollars ($1,000.00) for each violation.  Each day such violation continues shall constitute a separate offense.
   (b)   Violation of this article may result in license revocation and such violation will be reported to the state licensing body for such establishment.
   (c)   Furthermore, any owner, proprietor, or manger of such a premises who knowingly allows conduct within any such premises, which is a violation of Section 762.04 shall be charged with violating the same.
 
   (d)   All owners, proprietors or managers of any premises regulated by this article shall be responsible for compliance with Sections 762.05, 762.06, and 762.07 herein and may be charged for violating the same.
   (e)   Injunctive Relief.  The circuit court shall have jurisdiction to issue an injunction to enforce the purposes of this ordinance upon petition by the attorney for the municipality.
   (f)   Equitable remedies.  All equitable remedies in aid of chastity, morality and decency, as enacted by State law and found in W.  Va.  Code  §61-9 et seq., should such apply, shall be available to the municipality including, but not limited to: temporary and permanent injunctions, closing of the place or establishment and all other legal remedies as allowed by law.    (Ord.  02-06.  Passed 4-9-02.)
