1173.019 SWEEPSTAKES/INTERNET CAFES.
   (a)   For purposes of this Section,
      (1)   A "Sweepstakes/Internet Cafe" is defined as any premises upon which any Computerized Sweepstakes Device is located for the use or entertainment of the public, whether or not such premises has other business purposes of any nature whatsoever.
      (2)   A "Computerized Sweepstakes Device" is defined as any computer, machine, game or apparatus which, upon the insertion of a coin, token, access number, code, magnetic card, or similar object, or upon the payment or exchange of anything of value, provides a product or service, which may be operated by the public generally for use as a contest of skill, entertainment or amusement, whether or not registering a score, and which provides the user with a chance to win anything of value that is not de minimus, provided, however, that machines designated for use by the State Lottery Commission are not Computerized Sweepstakes Devices for purposes of this Section.
   (b)   (1)   A Sweepstakes/Internet Café shall not be permitted in any of the following Use Districts: R1-1, R1-2, R1-3, R1-4, R1-5, R2-1, MR-1, MR-1-A, MHPD-1, or in the Design Review District established under Section 1182.02 of the Codified Ordinances.
      (2)   Notwithstanding the other provisions of the Zoning Code, a Sweepstakes/Internet Cafe may be allowed in any other Use District not as a "permitted" use, but only as a "conditionally permitted" use pursuant to a Conditional Use Permit, in accordance with the Ordinances of the Village of Wellington, including but not limited to any business regulations specifically relating to Sweepstakes/Internet Cafes. Any Conditional Use Permit under consideration for a Sweepstakes/Internet Café shall require, at a minimum, all of the following:
         A.   The Café shall have at least one parking space which is dedicated to the Café during its hours of operation for each Computerized Sweepstakes Device on the premises.
         B.   The Café shall have at least 30 gross square feet of floor area for each Computerized Sweepstakes Device, excluding areas used for other principal uses.
         C.   No gambling in any form, nor the possession or use of gambling paraphernalia upon the premises shall be allowed.
