1173.04 GENERAL YARD REQUIREMENTS.
   In addition to all yard requirements specified in Chapter 1167 and in other sections of this Ordinance, the provisions of Section 1173.04, inclusive, shall be used for interpretation and clarification. Except as herein provided, every required yard shall be a required open space other than a court unoccupied and unobstructed by any structure or portion of a structure from three (3) feet above the general ground level of the graded lot upward, provided, accessories, ornaments, and furniture may be permitted in any yard, subject to height limitations and requirements limiting obstruction of visibility.
   (a)   Yard Requirements for Single Buildings. No required yard or other open space around a building shall be considered as a yard to open space for any other building. No required yard or other required open space on an adjoining lot shall be considered as providing the yard or open space on the lot whereon a building is to be erected or established.
   (b)   Yard Requirements for Multiple-Family Dwellings. Multiple-family dwellings shall be considered as one (1) building for the purpose of determining front, side, and rear yard requirements. The entire group as a unit shall require one (1) front, one (1) rear, and two (2) side yards as specified for dwellings in the appropriate district. Each individual building shall meet all yard requirements for the appropriate district as though it were on an individual lot.
   (c)   Visibility at Intersections. On a corner lot at the intersection of two (2) (existing or proposed) streets or at the intersection of an alley and a street within any district, nothing shall be installed, erected, placed, planted, or allowed to grow in such manner as to impede vision materially between a height of two and one-half feet (2-1/2 ft.) and ten feet (10 ft.) above the center line grades of the intersecting streets or of the intersecting alley and street in the area bounded by the right-of-way lines of such corner lots and a line joining points along said street lines, or alley and street lines fifty feet (60 ft.) from the point of intersection.
 
   (d) Accessory Buildings and Buildings.
      (1)    Fences, hedges, and walls: In all districts except industrial districts where other height requirements shall apply, fences, hedges, and walls may be constructed to a maximum height of six feet (6 ft.) in any required side or rear yard beginning at the building setback line and to a height of three feet (3 ft.) in any required yard abutting a street. Hedges shall not encroach on public sidewalks.
      (2)    Single-story garages:
         A.   In existing residential districts, a single-story detached garage may not be located within five feet (5 ft.) from any side or rear property line and may not be located closer than twenty feet (20 ft.) to any principal building. Additionally, such garages may not be located closer to the front building line than the principal building, unless the garage is attached thereto. The garage may not be larger than forty-five percent (45%) of the gross floor area of the principal use or structure and is not to exceed twelve hundred square feet (1,200 sq. ft.) maximum. Additionally, the garage, together with the principal dwelling/building, may not exceed lot coverage requirements for a given zoning district. Garages may not exceed a single story or fifteen feet (15 ft.) in height at any highest point.
         B.   In residential districts, if the residence has an attached garage, no detached garage shall also be constructed on the same lot. In residential districts, if the residence has no attached garage, one, and no more than one, detached garage may be constructed on the same lot.
         C.   A single one-story utility building may be located on a lot provided that it does not exceed two hundred square feet (200 sq. ft.) of floor space. Such utility building shall meet all building setback requirements. No utility building shall be located in any front yard or in front of the rear line of the principal building.
      (3)   Use of front yard.
         A.   Front yards in all single- and two-family dwelling districts shall be landscaped with living plant material with the exception of required driveways. Except for public safety/emergency vehicles, and except for short-term parking for washing & cleaning of vehicles, parties, reunions, and special events, parking in the front yard shall be permitted only on a lawful driveway.
         B.   Driveways shall be permitted for multiple-family dwellings in the front yard and, except for off-street parking which is otherwise authorized by the Zoning Code, the remainder of the lot shall be landscaped with living plant material. Except for public safety/emergency vehicles, and except for short-term parking for washing & cleaning of vehicles, parties, reunions, and special events, parking in the front yard shall be permitted only on a lawful driveway or off-street parking area.
         C.   In all districts, parking shall be permitted in the side or rear yard of the lot.
         D.   Nothing in this part (3) shall prevent the parking of vehicles in non-residentially zoned districts. (Ord. 2009-39. Passed 10-19-09.)
