(A) Any person, firm or corporation which violates any provision of § 541.09, shall be fined not less than $50 nor more than $500, and whether or not such person is convicted under § 541.09 such violation shall be deemed a nuisance which may be abated at any suit of any resident, taxpayer or the city; provided, however, that this provision shall not apply to the construction of dams, bridges or culverts which may be erected or constructed in compliance with the Public Service Commission and state regulations, as provided by statute.
(B) All other violations of this article shall be punished according to § 101.99.
