§ 533.03 CURFEW.
   (A)   Title. This section shall be known and may be cited as the Weirton Curfew Ordinance of 2003.
   (B)   Policy. It is hereby declared to be the policy of the city to safeguard the citizens from such vandalism and crime as is shown by experience to occur when unsupervised children are allowed to remain at large during the hours of darkness.
   (C)   Definitions. For purposes of this section the following definitions shall apply unless the context clearly indicates or requires a different meaning.
      CITY. The City of Weirton, Hancock and Brooke Counties, West Virginia.
      DAYLIGHT. When there is enough light to see objects clearly with the unaided eye.
      PUBLIC PLACE. Any street, sidewalk, park, cemetery, school yard, body of water or watercourse, public conveyance or any other place for the sale of merchandise, public accommodation or amusement (see Administrative Code, § 101.02).
   (D)   Enforcement. The Police Department and any other law enforcement agency with authority to act within the city limits shall have the power and duty to enforce the provisions of this section.
   (E)   (1)   No child under the age of 18 years shall be upon the streets or in other public places of the city after the hour of midnight and before daylight unless accompanied by a parent, guardian or some adult person lawfully in charge of such child.
      (2)   No parent, guardian or other person having the custody of a child under the age of 18 years shall allow such child to be upon the streets or in other public places in the city between the aforementioned times, unless accompanied by a parent, guardian or some adult person lawfully in charge of such child.
      (3)   This section shall not be construed so as to prohibit children under the age of 18 years from attending places of religious worship or meetings held by or under the auspices of the public schools or Boy Scouts and Girl Scouts or other like organizations, or from going to or from work or to or from a place of public entertainment unaccompanied by a parent, guardian or other adult person.
   (F)   Penalty. Any person violating any of the provisions of this section shall upon the conviction thereof be sentenced to pay a fine of not less than $25 nor more than $100, together with the costs, for the first violation and not less than $50 nor more than $300, together with the costs, for the second and subsequent violations.
