11-9-6: LANDSCAPE REGULATIONS; SINGLE-FAMILY DETACHED RESIDENCES ON INDIVIDUALLY ZONED LOTS:
   A.   Requirements: The property owner or applicant for a single- family residential building permit for construction of a single- family detached residence on an individually zoned lot is required:
      1.   To plant grass or install sod on the lot, exclusive of preserved wooded areas, landscaped areas or preserved or undisturbed natural areas.
      2.   To plant one tree of two and one-half inches (21/2") minimum diameter measured twelve inches (12") from the ground for each eight thousand (8,000) square feet of area of the lot, with the resulting number being rounded downward to eliminate a fraction. The trees to be planted must be selected from the varieties listed in section 11-9-14 of this chapter; fifty percent (50%) of the quantity required shall be from table I and fifty percent (50%) shall be from table II. Tables I, II and III are set out in section 11-9-14 of this chapter.
      3.   To complete such landscaping during the first growing season after the completion of construction, but in no event longer than twelve (12) months after the issuance of a building permit.
      4.   At the time of obtaining a building permit, to make a landscaping guarantee deposit with the village of a deposit equal to two hundred dollars ($200.00) per required tree to assure completion of landscaping requirements 1 .
      5.   To landscape detention/retention ponds in accordance with the appropriate requirements detailed in section 11-9-7, "Landscaping And Screening Regulations; All Other Sites", of this chapter, and to make a landscaping guarantee deposit in amount equal to the value of the landscaping required by those regulations.
   B.   Refund Of Deposit: At the time an owner or applicant requests a refund from the village of the landscaping guarantee deposit, in order to obtain such refund, evidence of compliance with the requirement of this chapter to plant trees of appropriate value must be presented to the building and zoning department, the planting of grass or sod as required in this chapter must be completed and the landscaping of retention/detention ponds must be completed, if applicable. If such evidence of compliance is not submitted within eighteen (18) months after issuance of a certificate of occupancy, in addition to other remedies provided in this title, such guarantee deposit shall be forfeited.
