1459.02 DECLARATION OF NUISANCE; ABATEMENT PROCEDURE.
   (a)   In the event that the owner, occupant, or lessee fails to comply with the provisions of Section 1459.01, the City Manager or the City Manager’s designee may, in addition to the penalty set forth in Section 1459.99, declare the accumulation of grass, weeds, vines, or other vegetation to be a nuisance, and after notice as specified in Section 1459.02(b) to the owner, occupant or lessee, upon failure of the owner, occupant, or lessee to abate the nuisance, may enter upon the property and cause such grass, weeds or vines, or other vegetation to be cut and charge the owner for the costs, expenses and administrative fees thereof.
   (b)   For purposes of this section, notice shall include the following:
      (1)   General notice to the public of the requirements of this chapter by publishing a notice in a newspaper of general circulation during the month of March each year, or as soon thereafter as practicable. The general notice shall indicate that vegetation reaching an average height of six inches or more will be cut by the City and the owner of the property charged with the costs, expenses and administrative fees thereof; and
      (2)   Individual notice shall be posted at the property or mailed to the owner of the property prior to a first cutting each calendar year.
      (3)   Subsequent violations in the same calendar year may be abated without further notice.
