(a) After receipt of reports from the Police Department, Building Department and Fire Department, the City Clerk shall submit the license application to the City Manager for approval or disapproval. If a violation has been issued against the applicant, pursuant to Section 840.04(c), the City Manager may approve a license, subject to the following conditions:
(1) If the applicant was issued a safety violation by the Building Department and/or Fire Department, the City Manager may grant a thirty day temporary license that shall automatically convert to a license, subject to the correction of all violations.
(2) If the applicant was issued a maintenance violation by the Building Department and/or Fire Department, the City Manager may grant a six month temporary license that shall automatically convert to a license, subject to the correction of all violations.
(3) A violation shall be considered corrected upon the completion of a reinspection by the Building Department and/or Fire Department who issued the violation and such department submitting to the Clerk's office a report of compliance. It shall be the responsibility of the licensee to schedule with the Building Department and/or Fire Department all reinspections.
(b) Upon approval by the City Manager, the City Clerk shall issue the license required by this chapter. Such license shall expire on the first day of March each year following the date of issuance.
(c) If the license application is not approved by the City Manager, the Clerk shall notify the applicant and return to such applicant one-half of the license fee previously paid, retaining one-half of such amount to help defray the cost of processing the license application and making inspections.
(d) If the licensee does not comply with the conditions set forth in this section, the Clerk shall notify the licensee of his non-compliance and the license fee previously paid shall be forfeited to the City.
