§ 99.03 USE OF CITY EQUIPMENT FOR PRIVATE WORK PROHIBITED.
   (A)   The Superintendent of Streets shall not use any equipment or laborers in the employment of and paid by the city for the performance of any work, labor or service for any person other than the city, except in cases where the requirements of the Charter, this code and ordinances of the city make the performance of the work, labor or service necessary for such persons as neglect or refuse to comply therewith.

   (B)   Division (A) above shall not be so construed as to prevent or preclude the Superintendent of Streets, with and by the consent or direction of the Board of Public Works, from obtaining gravel or other material for use on the streets of the city from the lands of any person by digging cellars or grading lots whence the gravel or material may be obtained.
