§ 38.087 CONTRACT PROVISIONS PERTAINING TO AN ORDINANCE REGARDING THE HIRING OF WATERBURY RESIDENTS ON CERTAIN PUBLICLY-FUNDED CONSTRUCTION PROJECTS.
   (A)   The city shall, in all contracts or purchase orders for a covered project, as that term is defined § 34.17, Definitions, of Chapter 34, entitled Hiring Of Waterbury Residents On Certain Publicly-Funded Construction Projects (The “Good Jobs Ordinance”), of the Code of Waterbury, include the provisions required pursuant to § 34.22 of the Good Jobs Ordinance.
   (B)   The foregoing notwithstanding, the Director of Purchasing is hereby authorized, with respect to any given contract, to determine that the inclusion of the aforementioned provisions have resulted in the inability of the city to secure a contract that is advantageous to the city. Any finding by the Director of Purchasing pursuant to this division (B) must be made prior to the award of the contract or purchase order in question and it must be evidenced by a writing signed by him stating his reasons for the determination. Upon making such a determination the Director of Purchasing shall forward a copy of the written determination to the using agency that commenced the procurement process relative to the contract or purchase order in question. The using agency may then request a waiver of the requirement to include such provisions in the subject contract or purchase order from the Board of Aldermen.
