§ 51.999 PENALTY.
   (A)   Any person who violates any provision of this chapter for which no specific penalty has been provided, or any permit condition, or who violates any cease and desist order, prohibition, effluent limitation, or pretreatment or toxicity standard, shall be liable civilly to a penalty not to exceed $1,000 for individuals and $5,000 for corporations. Each day in which violation occurs shall be considered as separate violation.
      (1)   The city may assess a penalty of up to $1,000 for each such violation and add such penalty to the user's charges and fees. Such assessment shall be offset against any subsequent penalty otherwise imposed for the same violation.
      (2)   Any such penalty imposed shall not be construed as liquidated damages and shall accrue in addition to any liability for any consequential damages resulting from the violation for which the penalty imposed.
   (B)   Any person who violates § 51.098 shall, upon conviction, be punished by a fine of not more than $1,000 or by imprisonment for not more than six months, or both.
   (C)   Any person violating the provisions of §§ 51.190 through 51.194 shall be subject to a penalty of $100 per violation. In addition, such person shall be liable for any expense, loss, or damage occasioned by reason of such violation.
